IP Australia, the Government agency responsible for administering intellectual property law in Australia, has announced a series of fee changes that will commence from midnight on 1 October 2024.  The changes follow a 15-month review process.  

IIP’s clients should specifically note the introduction of an excess claims fee for patent applications with more than 20 claims, to be calculated and charged upon issuances of the first examination report. Excess claim fees will also be incurred at acceptance if the number of claims has increased beyond 20 during examination. 

In addition, a new $250 fee is payable for each additional ground relied upon in a trade mark opposition beyond the first three grounds, as well as a $500 fee for filing late evidence.
